1. Agreement to Terms

By accessing and using Childcare Temps ("Platform", "Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Service Description

Childcare Temps is an online platform that connects childcare professionals ("Temps") with families, schools, and childcare centers ("Clients"). We provide a marketplace for these parties to connect, communicate, and arrange childcare services.

IMPORTANT: Childcare Temps is a CONNECTION PLATFORM ONLY. We do not employ temps, provide childcare services, conduct background checks, verify credentials, or process payments. All agreements, employment relationships, and liability exist solely between Temps and Clients.

3. User Accounts

3.1 Registration

• You must be 18 years or older to use this platform
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You may not transfer your account to another person

3.2 Temp Accounts (FREE)

• Creating a temp profile is completely free
• Temps may upgrade to Premium Visibility ($9.99/month) to appear at the top of search results
• Temps are responsible for uploading their own credentials and documents
• Temps must ensure all information provided is accurate and up-to-date

3.3 Client Accounts (PAID SUBSCRIPTION)

• Standard Plan: $12.99/month - Single plan with all features included
• Subscription includes: unlimited browsing, messaging, Zoom meeting requests, booking management, and analytics
• Subscriptions are billed monthly and auto-renew unless cancelled
• You may cancel your subscription at any time through your account settings
• No refunds for partial months

4. Platform Functionality

4.1 For Temps

• Create a professional profile with photo, bio, and credentials
• Upload credential documents (background checks, certifications, licenses)
• Receive messages and meeting requests from clients
• Apply to job postings
• Submit timesheets for work performed
• Optional: Upgrade to Premium Visibility for enhanced profile placement

4.2 For Clients

• Browse temp profiles with detailed information
• Filter by location, experience, certifications, and more
• Message temps directly
• Request Zoom meetings for interviews
• Book temps for specific dates and times
• Review and approve timesheets
• Leave ratings and reviews

5. Background Checks & Verification

⚠️ CRITICAL: Childcare Temps DOES NOT conduct, verify, or guarantee the accuracy of background checks, credentials, or certifications. We provide a platform for temps to upload their documents, but WE DO NOT VERIFY THEM.

• Temps are responsible for obtaining and uploading their own background checks
• Clients are solely responsible for reviewing, verifying, and validating all credentials and documents
• Childcare Temps makes no representations about the accuracy or validity of any uploaded documents
• Clients should independently verify all credentials before hiring
• Our platform displays uploaded documents but provides no warranty as to their authenticity

BY USING THIS PLATFORM, YOU ACKNOWLEDGE THAT YOU ARE SOLELY RESPONSIBLE FOR CONDUCTING YOUR OWN DUE DILIGENCE, INCLUDING BACKGROUND CHECKS, REFERENCE CHECKS, AND CREDENTIAL VERIFICATION.

6. Independent Contractor Relationship

ALL TEMPS ARE INDEPENDENT CONTRACTORS, NOT EMPLOYEES OF CHILDCARE TEMPS.

• Temps are self-employed and responsible for their own taxes, insurance, and licensing
• Childcare Temps does not control how, when, or where temps perform their services
• The relationship between temps and clients is direct - Childcare Temps is not a party to any agreement
• Temps are responsible for maintaining their own liability insurance
• Temps must comply with all applicable laws, regulations, and licensing requirements

7. Payments

7.1 Platform Subscriptions (Paid to Childcare Temps)

• Client Subscription: $12.99/month (billed via Stripe)
• Temp Premium Visibility: $9.99/month (optional upgrade)
• All platform fees are non-refundable
• Failed payments may result in account suspension

7.2 Service Payments (Between Clients and Temps)

• Childcare Temps DOES NOT process payments for childcare services
• Payment for services is arranged directly between clients and temps
• Clients and temps agree on rates and payment methods independently
• We provide timesheet tools to track hours, but payment is the responsibility of both parties
• We are not responsible for payment disputes, non-payment, or payment processing

8. Prohibited Conduct

Users may not:

• Provide false or misleading information
• Impersonate another person or entity
• Upload fraudulent credentials or documents
• Harass, threaten, or abuse other users
• Attempt to circumvent platform fees by taking relationships off-platform
• Use the platform for any illegal purpose
• Scrape, copy, or steal user data
• Discriminate based on race, religion, gender, age, or other protected classes

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILDCARE TEMPS SHALL NOT BE LIABLE FOR ANY:

• Injuries, damages, or losses arising from services provided by temps
• Disputes between temps and clients
• Non-payment or payment disputes
• Inaccurate or fraudulent credentials or background checks
• Actions or omissions of temps or clients
• Quality of childcare services provided
• Employment law violations or independent contractor misclassification
• Tax obligations or insurance coverage

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO CHILDCARE TEMPS IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Childcare Temps, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

• Your use of the platform
• Your provision or receipt of childcare services
• Your violation of these Terms of Service
• Your violation of any rights of another user or third party
• Any injuries, damages, or losses resulting from services arranged through the platform

11. Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent activity
• Receive multiple complaints from other users
• Fail to pay subscription fees
• Create safety concerns for other users

12. Dispute Resolution

Any disputes arising from these Terms of Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to participate in class action lawsuits.

13. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
